Personal Data Notice
This Personal Data Notice (“Notice”) is issued pursuant to the requirements of the Personal Data Protection Act 2010 and describes how Hew, Lee & Co uses your Personal Data.
By engaging Hew, Lee & Co to provide services or by interacting with Hew, Lee & Co either at our events, conferences, seminars, talks or otherwise, or by using our website (“Website”), you consent to the processing of your Personal Data by Hew, Lee & Co and all persons involved in the provision of services by Hew, Lee & Co.
In the event of any conflict between the English and other language versions, the English version shall prevail. Hew, Lee & Co shall have the right to modify, update or amend the terms of this Notice at any time by placing the updated Notice on the Website. By continuing to communicate with Hew, Lee & Co or by continuing to use Hew, Lee & Co’s services following the modifications, updates or amendments to this Notice, this shall signify your acceptance of such modifications, updates or amendments.
Collection of Personal Data
1. “Personal Data” means information about you which you have provided to Hew, Lee & Co, such as your name, address, telephone number, NRIC/Passport number, email address, your personal preferences, particulars of your spouse or family members and bank account information and any information which may identify you, your spouse or family members that has been or may be collected, stored, used and processed by Hew, Lee & Co from time to time.
2. In addition to the Personal Data you provide to Hew, Lee & Co directly (i.e. during your communication with Hew, Lee & Co and/or when you engage Hew, Lee & Co to provide services), Hew, Lee & Co may also collect your Personal Data from a variety of sources, including without limitation at any events, conferences, seminars or talks organised or sponsored by Hew, Lee & Co and/or from the cookies used on the Website.
3. The provision of your Personal Data is voluntary. However, if you do not provide your Personal Data, Hew, Lee & Co may not be able to (i) communicate with you; (ii) provide you the services you require; or (iii) access certain sections of the Website where log in is required.
4. If you do not wish for your Personal Data to be collected via cookies on the Website, you may deactivate cookies.
Purposes of Processing
5. Hew, Lee & Co may use and process your Personal Data for the purposes relating to the services you have requested and for the business activities of Hew, Lee & Co which shall include, without limitation:
- to communicate with you;
- to respond to questions and comments from you;
- for internal administrative purposes;
- to provide information to regulatory and governmental authorities in order to comply with statutory and government requirements, including disclosure to the Unclaimed Money Management Division of the Accountant General’s Department of Malaysia (“AGD”) of your information as required pursuant to the Unclaimed Moneys Act 1965 and its attendant regulations in the event of any unclaimed monies on your part;
- for Hew, Lee & Co to comply with its obligations under law, including compliance with laws relating to evidence; and you agree and consent to Hew, Lee & Co using and processing your Personal Data in the manner as identified in this Notice.
Other purposes
6. Hew, Lee & Co may also use and process your data for other purposes such as:
- to send you materials such as newsletters, articles, write-ups as well as other updates;
- to distribute information or details of events, seminars, conferences and talks which may of interest to you;
- to send as potential referees to :
- editors/researchers in ranking legal publications and journals;
- potential clients who request for referees of past work in Requests for Proposals, tenders, submissions;
by way of email or mail;
- to state in the law firm profile of Hew, Lee & Co as a current and/or former client of Hew, Lee & Co.
7. If you do not consent to Hew, Lee & Co processing your Personal Data for the purposes listed in paragraph 6, please notify Hew, Lee & Co using the contact details stated in paragraph 10 below.
Transfer of Personal Data
8. As Hew, Lee & Co's information technology storage facilities and servers may be located in other jurisdictions, your Personal Data may be transferred to, stored, used and processed in a jurisdiction other than Malaysia. Further, your personal data may be transferred out of Malaysia for the purposes as described in paragraph 6(c) where such ranking legal publications and journals and/or potential clients are located outside of Malaysia. You understand and consent to the transfer of your Personal Data out of Malaysia as described herein.
Disclosure to Third Parties
9. Hew, Lee & Co may engage other companies, service providers or individuals to perform functions on Hew, Lee & Co’s behalf, and consequently may provide access or disclose to your Personal Data to the third parties such as those listed below (not exhaustive):
- information technology (IT) service providers;
- data entry service providers;
- storage facility providers;
- banks and financial institutions;
- insurance providers;
- any professional advisors and external auditors;
- regulatory and governmental authorities in order to comply with statutory and government requirements, including to the AGD for the purposes as described in paragraph 5 above.
Access & Correction Requests and Inquiries
10. Subject to any exceptions under applicable laws, you may at any time hereafter request:
- for access to your Personal Data
- for correction or rectification of your Personal Data;
- to limit the processing of your Personal Data; or
- to seek further information from Hew, Lee & Co regarding the processing of your Personal Data by contacting:

11. In respect of your right to access and/or correct your Personal Data, Hew, Lee & Co has the right to refuse your requests to access and/or make any correction to your Personal Data for the reasons permitted under law, such as where the expense of providing access to you is disproportionate to the risks to your privacy.

Notis Data Peribadi
Notis Data Peribadi ini ("Notis") diberi selaras dengan kehendak Akta Perlindungan Data Peribadi 2010 dan menerangkan bagaimana Hew, Lee & Co menggunakan Data Peribadi anda.
Dengan melantik Hew, Lee & Co untuk menyediakan perkhidmatan atau dengan berhubung dengan Hew, Lee & Co sama ada di acara, persidangan, seminar, ceramah atau sebaliknya, atau dengan menggunakan laman web Hew, Lee & Co ("Laman Web"), anda bersetuju dengan pemprosesan Data Peribadi anda oleh Hew, Lee & Co dan semua orang yang terlibat dalam penyediaan perkhidmatan oleh Hew, Lee & Co.
Jika berlaku sebarang percanggahan di antara versi Bahasa Inggeris dan versi bahasa lain, versi Bahasa Inggeris akan diguna pakai. Hew, Lee & Co berhak untuk mengubahsuai, mengemaskini atau meminda terma-terma Notis ini pada bila-bila masa dengan meletakkan Notis yang dikemaskinikan di Laman web. Dengan terus berkomunikasi dengan Hew, Lee & Co atau dengan terus menggunakan perkhidmatan Hew, Lee & Co berikutan pengubahsuaian, pengemaskinian atau pindaan kepada Notis ini ia hendaklah dianggap sebagai penerimaan anda terhadap pengubahsuaian, pengemaskinian atau pindaan tersebut.
Pengutipan Data Peribadi
1. “Data Peribadi” bermaksud maklumat mengenai anda yang anda telah diberikan kepada Hew, Lee & Co, seperti nama, alamat, nombor telefon, No KP/Pasport, alamat e-mel, rujukan peribadi anda, butir-butir pasangan atau ahli-ahli keluarga anda dan maklumat bank akaun dan sebarang maklumat yang boleh mengenal pasti anda, pasangan atau ahli-ahli keluarga anda yang telah atau akan dikutip, disimpan, digunakan dan diproses oleh Hew, Lee & Co dari semasa ke semasa.
2. Sebagai tambahan kepada Data Peribadi yang anda berikan kepada Hew, Lee & Co secara langsung (contohny semasa anda berkomunikasi dengan Hew, Lee & Co, apabila anda melantik Hew, Lee & Co untuk memberi perkhidmatan atau semasa mengemukakan borang pemohonan, ‘curriculum vitae’ dan resume anda), Hew, Lee & Co juga mungkin mengutip Data Peribadi anda daripada pelbagai sumber, termasuk tetapi tidak terhad kepada sebarang acara, persidangan, seminar atau ceramah yang diatur atau ditaja oleh Hew, Lee & Co dan/atau daripada cookies yang digunakan di Laman Web.
3. Pemberian Data Peribadi anda adalah secara sukarela. Walau bagaimanapun, jika anda tidak berikan Data Peribadi anda, Hew, Lee & Co tidak mungkin dapat i) berkomunikasi dengan anda; ii) menyediakan perkhidmatan yang anda perlukan; (iii) mengakses seksyen tertentu pada Laman Web di mana log masuk dikehendaki.
4. Jika anda tidak ingin Data Peribadi anda dikutip melalui cookies di Laman web, anda boleh menyahaktifkan cookies.
Tujuan Pemprosesan
5. Hew, Lee & Co boleh menggunakan dan memproses Data Peribadi anda untuk tujuan berkaitan dengan perkhidmatan yang anda minta dan untuk aktiviti-aktiviti perniagaan Hew, Lee & Co yang termasuk, tanpa had:
- Untuk berkomunikasi dengan anda;
- Untuk menjawab soalan-soalan dan ulasan daripada anda;
- Untuk tujuan pentadbiran dalaman;
- Untuk memberi maklumat kepada pihak berkuasa kawal selia dan kerajaan bagi mematuhi syarat-syarat di bawah undang-undang dan kerajaan, termasuk pendedahan kepada Bahagian Pengurusan Wang Tak Dituntut dari Jabatan Akauntan Negara Malaysia (“AGD”) maklumat anda seperti yang dikehendaki menurut Akta Wang Tak Dituntut 1965 dan peraturan-peraturan sekiranya terdapat apa-apa wang yang tidak dituntut oleh anda;
- Untuk Hew, Lee & Co mematuhi obligasinya di bawah undang-undang; dan anda bersetuju dan mengizinkan Hew, Lee & Co untuk menggunakan dan memproses Data Peribadi anda menurut cara sebagaimana yang dikenalpastikan dalam Notis ini.
Tujuan lain
6. Hew, Lee & Co boleh juga menggunakan dan memproses data anda untuk tujuan lain seperti:
- Untuk menghantar bahan-bahan kepada anda seperti surat berita, artikel, penulisan serta pengemaskinian yang lain;
- Untuk mengedar maklumat atau butir-butir acara, seminar, persidangan dan ceramah yang mungkin anda minati;
- Untuk menghantar sebagai perujuk berpotensi kepada :
- editor/penyelidik) di penerbitan dan jurnal undang-undang bertaraf;
- pelanggan-pelanggan berpotensi yang meminta perujuk untuk kerja terdahulu dalam permohonan untuk cadangan, tender, penyerahan melalui e-mel atau pos;
- Untuk menyatakan dalam profil firma guaman Hew, Lee & Co sebagai klien semasa dan / atau bekas klien Hew, Lee & Co.
7. Jika anda tidak bersetuju dengan Hew, Lee & Co memproses Data Peribadi anda untuk tujuan yang disenaraikan dalam perenggan 6, sila maklum kepada Hew, Lee & Co dengan menggunakan butiran hubungan yang dinyatakan dalam perenggan 8 di bawah.
Pemindahan Data Peribadi
8. Oleh sebab kemudahan simpanan teknologi maklumat dan pelayan mungkin terletak dalam bidang kuasa lain, Data Peribadi anda mungkin dipindahkan, disimpan, digunakan dan diproses dalam bidang kuasa selain daripada Malaysia. Selanjutnya, Data Peribadi anda mungkin dipindahkan keluar dari Malaysia untuk tujuan sebagaimana yang diperihalkan dalam perenggan 6(c) di mana penerbitan dan jurnal undang-undang bertaraf dan/atau pelanggan-pelanggan berpotensi berada di luar Malaysia. Anda memahami dan bersetuju untuk pemindahan Data Peribadi anda keluar dari Malaysia sebagaimana yang diperihalkan di sini.
Pendedahan kepada Pihak Ketiga
9. Hew, Lee & Co boleh melantik syarikat-syarikat, penyedia-penyedia perkhidmatan atau individu-individu lain untuk melaksanakan fungsi bagi pihak Hew, Lee & Co, dan sebagai akibat boleh menyediakan akses atau mendedahkan Data Peribadi anda kepada pihak-pihak ketiga sebagaimana yang disenaraikan di bawah (tidak terhad):
- Penyedia-penyedia perkhidmatan teknologi maklumat (IT);
- Penyedia-penyedia perkhidmatan kemasukan data;
- Penyedia-penyedia kemudahan simpanan;
- Bank dan institusi kewangan;
- Penyedia-penyedia insurans;
- Sebarang penasihat profesional dan juruaudit luar;
- Pihak berkuasa kawal selia dan kerajaan bagi mematuhi syarat-syarat di bawah undang-undang dan kerajaan, termasuk kepada Jabatan Akauntan Negara Malaysia untuk tujuan seperti yang dinyatakan dalam perenggan 5 di atas.
Akses & Permohonan Pembetulan dan Pertanyaan
10. Tertakluk kepada sebarang pengecualian di bawah undang-undang yang diguna pakai, anda boleh pada bila-bila masa selepas ini memohon akses kepada, atau untuk pembaikan dan pembetulan Data Peribadi anda atau menghadkan pemprosesan Data Peribadi anda, atau memohon maklumat lanjut berkenaan pemprosesan Data Peribadi anda daripada Hew, Lee & Co dengan menghubungi:

11. Berkenaan dengan hak anda untuk mengakses dan/atau membetulkan Data Peribadi anda, Hew, Lee & Co berhak untuk menolak permohonan anda untuk mengakses dan/atau membuat sebarang pembetulan pada Data Peribadi anda atas alasan-alasan yang dibenarkan di bawah undang-undang, seperti apabila pemberian akses kepada adalah tidak seimbang dengan risiko kepada privasi anda.
